Terms of Service

1. Agreement
By using Cleverly, you agree to these Terms of Service and our related policies. If you use the Service on behalf of an institution, you confirm you are authorized to bind that institution.
2. Service description
Cleverly provides AI-assisted grading workflows, including course setup, rubric handling, submission processing, analytics, and export tools for education teams.
3. Account responsibilities
You are responsible for account security, lawful use, and all activities performed under your account. You must provide accurate registration and billing information.
4. Billing and payments
Paid subscriptions are billed in advance according to the selected plan. Refunds and cancellations are governed by our published Refund and Cancellation Policies.
5. Acceptable use
You may not use the Service for unlawful conduct, unauthorized data processing, abuse of infrastructure, or infringement of intellectual property rights.
6. Data and privacy
We process data in line with applicable law and our Privacy Policy. You remain responsible for having a lawful basis to upload and process learner/educator data.
7. Service availability
We aim for reliable operation but do not guarantee uninterrupted service. Planned maintenance and incident response may affect availability.
8. Limitation of liability
To the maximum extent permitted by law, Cleverly is not liable for indirect or consequential losses. Total liability is limited to amounts paid by you in the previous 12 months.
9. Termination
We may suspend or terminate access for breach of these terms, security risk, or legal requirements. You may stop using the Service at any time.
10. Governing law
These terms are governed by the laws of South Africa unless a separate institutional agreement states otherwise.
